Terms of Service

The rules of play. What you can expect from our games, what we ask of you in return, and how accounts, purchases and the occasional disagreement are handled.

The agreement

These Terms of Service are a contract between you and TNW Studios (The New Wave Studios). They cover our games, this website, and anything else we publish that links back to them. By downloading a game, creating an account, or simply using the site, you accept these terms.

If you do not accept them, please stop playing and uninstall. We would rather lose a player than hold you to something you disagree with.

Before publishing, confirm our registered legal entity and the governing-law jurisdiction in the sections on disputes, plus whether you want an arbitration clause. Both are placeholders right now.

Who can play

You must be old enough to agree to a contract in your country, or play with the permission of a parent or guardian who does. Where a game is aimed at a younger audience, it will carry its own consent flow and rules before it is available to them.

You also confirm you are not using the games for anything unlawful, and that you will play them yourself rather than reselling access.

What you get

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and play our games on devices you control, for your own enjoyment. That is a licence, not a sale: the games, artwork, characters, music, names and code stay ours.

  • Do not copy, modify, translate or create derivative works from the games.
  • Do not reverse engineer, decompile or tamper with the code or its security.
  • Do not sell, rent, sublicense or bundle access to the games.
  • Do not use our names, logos or characters to promote something else without asking first.

Accounts

Some games let you link an account so your progress follows you between devices. You are responsible for keeping your login safe and for activity that happens under it. Tell us quickly at hello@tnwstudios.games if you think someone else has it, and we will help lock things down.

In-app purchases and virtual items

  • Our games are free to try. Some offer optional purchases of coins, gems, skins, level packs or similar virtual items using real money.
  • Billing runs through your app store. Prices are shown before you confirm, and the store’s own billing, tax and currency rules apply.
  • Virtual items are a licence to use them inside the game. They have no value outside it, cannot be exchanged for money, and cannot be moved between accounts.
  • Consumable items, such as extra lives or boosters, are used up when you spend them. Non-consumables stay available as long as the game supports them.
  • Refunds are handled by your app store under its policy and any consumer rights you cannot give up. We are happy to support your request if the store asks us to.
  • Where a subscription is offered, it renews until cancelled, and you can cancel at any time in your store settings.

Nothing in our games is real-money gambling. Where a paid item uses chance, such as a randomised pack, we disclose the odds where the law or a store requires it.

Being a decent player

Our games are small, friendly spaces. Please keep them that way. In particular, do not:

  • Cheat, exploit bugs for advantage, or use bots, mods or third-party tools that change the game.
  • Harass, threaten, impersonate or discriminate against other players or our staff.
  • Post hateful, sexual, violent or otherwise unlawful material in a name, chat, profile or review we host.
  • Spam, phishing-link, or scrape content or player information.
  • Interfere with servers, run denial-of-service attacks, or probe our systems for weaknesses without permission.

If something breaks these rules we can warn you, roll back unfair gains, suspend or close the account, and where the law is involved, report it. We will always aim for the lightest response that fits.

Things you create

You keep ownership of what you make: your display name, level designs, screenshots and messages. By sharing them in a game we host, you give us a worldwide, royalty-free licence to store, display and adapt them so the feature works — for example showing your level to other players, or using a screenshot in a store listing.

Send us an idea and we will treat it as feedback, not a secret. We may use it freely, without owing you anything, but we will never claim your name or your work as ours.

Third-party services

Games lean on other companies: app stores for downloads and billing, analytics and crash tools to keep things healthy, and sometimes advertising networks. Those services have their own terms and privacy policies, and once you leave our control we cannot speak for them. Read theirs where it matters to you.

Updates and availability

Mobile games are never really finished. We push updates that add content, tune difficulty and fix bugs, and occasionally we retire a feature, change how something works, or stop supporting an old device or operating system. We will not do it silently where it affects what you paid for, and where a store lets us, we will give you notice.

We also cannot promise uninterrupted service. Servers go down, platforms change, and force majeure happens. We will always work to get things back up quickly.

Ending things

You can stop playing at any time and ask us to delete your account and progress. We can end or suspend a licence if these terms are broken or if we have to for legal or safety reasons. Sections that should survive — ownership, disclaimers, liability limits, governing law — keep standing after that.

Disclaimers

THE GAMES ARE PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULLEST EXTENT THE LAW ALLOWS, TNW STUDIOS AND ITS PARTNERS GIVE NO OTHER WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE GAMES WILL BE ERROR-FREE, UNINTERRUPTED, OR THAT ANY ITEM WILL ALWAYS BE AVAILABLE.

Some countries and states do not allow certain disclaimers, so parts of this may not apply to you.

Limitation of liability

TO THE FULLEST EXTENT THE LAW ALLOWS, TNW STUDIOS IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE LOSS, OR FOR LOST DATA, PROGRESS, VIRTUAL ITEMS OR PROFITS. WHERE LIABILITY CANNOT BE EXCLUDED, IT IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US FOR THE GAME IN THE TWELVE MONTHS BEFORE THE CLAIM AND ONE HUNDRED US DOLLARS.

These limits do not apply to anything consumer law says cannot be limited, such as our gross negligence, fraud, or personal injury caused by our fault.

If you cause a problem

If you break these terms or the law while using our games and someone comes after us because of it, you agree to cover our reasonable costs and losses arising from that. This does not apply where the problem was actually ours.

Changes to these terms

We may update these terms as the games and the law change. We will revise the “last updated” date above, and for changes that materially affect what you paid for we will do our best to notify you in the game or by email. Continuing to play after an update is published means you accept it.

Governing law and disputes

Let us try to sort it out first: write to hello@tnwstudios.games, describe the problem, and a human will look at it. Most things never need to go further.

If we genuinely cannot resolve it, these terms are governed by the laws of the jurisdiction we confirm at launch, and the courts of that place handle the dispute — without stopping you from bringing a claim in your own country if your local consumer law gives you that right.

The rest

  • If a court finds one clause unenforceable, the rest of the terms carry on without it.
  • We can pass our rights and obligations to an affiliate or buyer of the studio; you cannot hand yours to someone else without our say-so.
  • If we do not enforce something today, that is not us giving it up.
  • These terms, together with our Privacy Policy, are the whole understanding between us about the games.
